Mediation, or conflict resolution, can be used when two (or more) persons and/or organisations have a conflict with one other. A (long-lasting) conflict is usually accompanied by frustration and takes a lot of negative energy. The impact is huge and you have the feeling that you cannot escape from it. Entering into a good conversation can create a bridge and often does wonders in finding a solution. Yet there are situations in which, due to emotions and/or the stakes involved, you are at a loss and the situation hardens. In those cases, a solution seems a long way off. How exactly does mediation work?

As an MfN registered mediator, I act as a neutral and independent party. I supervise the communication process between both parties. Most conflicts have their origin in the relationship between parties. There is ample room to talk about what the issue has done to you, what you would like yourself and why that is important to you. Therefore, it is important that parties are willing to listen to each other and want to resolve the issue together.

During the mediation process, the parties remain in control, they have ownership of what is discussed and they work together towards a solution that is acceptable to both parties. Any agreements made during the mediation are recorded in a document, signed by both parties. This way, the mediation is also lasting in terms of results in the future.

Labour mediation (also referred to as workplace mediation) in the event of a labour conflicts can lead to restoring or improving:

  • Ending the employment relationship (exit mediation)

An important condition for mediation is that it takes place on a voluntary basis. Furthermore, it is important that all parties, including the mediator, observe a duty of confidentiality. This obligation means that everything that is discussed during the mediation process remains strictly confidential, even after the process has been completed, thus creating more freedom to discuss matters.
